Terms & Conditions

#1 Reporting for departure: Every passenger (“you” or “your”) must report to the ticket office of Kawau Boatshed Limited (“Kawau Cruises”, “we”, “our” or “us”), or the Driver of the vessel, at least 30 minutes prior to the scheduled departure time of the vessel. Failure to report may result in you losing your space on the vessel.

#2 Timetables and cancellations:

  1. All vessels, sailings, services, timetables and itineraries are subject to change at our sole discretion for reasons of marine conditions and/or operational requirements. We will not be liable for any losses, costs or expenses (including any special, indirect or consequential losses or costs) suffered or incurred as a result of any cancellation of a vessel, sailing or service or for any change to any timetable or itinerary.
  2. If you have booked a time on one of Kawau Cruises’ cruises, we recommend you contact us 24 hours beforehand to confirm your booking on +64 9 425 8006 (during standard business hours).
  3. Kawau Cruises’ operates its Sunday timetable for all services on all public holidays except Christmas Day. Limited services are operated on Christmas Day. For details of these services, please contact us by telephone.
  4.  Timetables are strictly adhered to, to the extent possible by us, and your failure to arrive for the nominated sailing time constitutes a non-refundable cancellation.
  5. We reserve the right to make changes to all prices, sailings and/or cancel a sailing without notice.
#3 Type of vessel: Kawau Cruises’ reserves the right to select the vessel it uses for any service it provides, and the vessel used for a particular service may be changed from time to time, or on short notice, at our sole discretion.

#4 Tickets:

  1. You must have a valid ticket to travel. If a ticket is lost, stolen, defaced or mutilated, the ticket will not be reissued and a replacement ticket must be purchased before you can travel.
  2. Unused portions of concession tickets are non-refundable.
  3. Tickets are only refundable in the event that we cancel the relevant service.
  4. You may be requested to show a valid ticket at any time. All tickets remain the property of Kawau Cruises.
  5. All tickets must be used within any applicable period on them and in accordance with these terms and conditions and any terms and conditions on the ticket. If there is any inconsistency between the terms and conditions on this website and the terms and conditions on the ticket, the terms and conditions on the ticket shall prevail.
  6. A ticket does not guarantee you a seat on any vessel.
  7. All prices are in NZ$ and include GST (15%). All payments are to be in NZ$ and must include payment for any bank charges.
  8. Prices for all services offered by Kawau Cruises are subject to change.

#5 Fare types: Your fare type is determined in accordance with the following table:

* Discounted rates may be offered to tertiary students and senior citizens on some services (and if no discount is offered, the adult fare shall apply). If applying for a discount, you should check with the Kawau Cruises’ ticket office when purchasing your ticket. In no circumstances will you be entitled to a discount unless you provide an identification card as to your status that is acceptable to Kawau Cruises (e.g. Maxx Tertiary Student I.D. Card or SuperGold Card).

** All children and infants under the age of 16 must be under adult supervision.

#6 Reservations:

  1. Travel on all services provided by Kawau Cruises’ is subject to available space on the vessel.
  2. Reservations are required for the following services:
    • Super Cruise Royal Mail Run
    • Mansion House Cruise
    • High Speed Discovery Tour
    • Camp Bentzon School Groups
    • Camp Bentzon Weekend Groups
    • Motutara Island
    • Little Barrier Island
    • Great Barrier Island

    Reservations and/or tickets for the above services may only be exchanged or refunded up to 48 hours prior to the time of travel. No refunds will be given for cancellations within 48 hours of the time of travel.

  3. A deposit may be requested to confirm your reservation or booking for a charter or large group on any particular service in which case it will be a nonrefundable payment if you cancel your reservation or booking.

#7 Driver’s authority over vessel and passengers: The Driver of the vessel has the right to refuse any person access to, or passage on, any vessel for any reason, including any person who is:

  1. carrying any noxious plant, animal pest or dangerous goods;
  2. impaired from alcohol or drugs;
  3. abusive or uses offensive language; or
  4. unfit to travel,

or any person who may cause distress or discomfort to other passengers. The Driver may also require any person who has boarded a vessel to leave that vessel at any time.

#8 No smoking: No smoking is permitted on any of Kawau Cruises’ vessels or areas under the control of Kawau Cruises.
#9 Alcohol: Some of Kawau Cruises’ vessels are premises licensed to sell alcoholic beverages. Only alcohol purchased on board may be consumed on the vessel.

#10 Freight and luggage:

  1. Prior arrangements must be made with us for the transportation of any freight or bulky items (including, but not limited to, building materials and furniture). The transportation of any freight or bulky item is at our sole discretion. A fee will be charged for any freight or bulky item we agree to transport and such fee shall be determined at our sole discretion.
  2. All freight and other bulky items must be registered at our ticket office by at least 9.30am on the day of transport and you will be required to personally arrange man power, at your own cost, for the loading and offloading of any such items.
  3. Luggage allowances for passengers are set out below:

    * Each box and bag carried must be the size of a banana box or smaller.

  4. Oversized and/or excess luggage will be carried at our sole discretion. You will be charged for all oversized or excess luggage which you are permitted to carry on a vessel in accordance with the following:
    1. other luggage will be charged at a rate of $10.00 (GST inclusive) per piece,

    and Kawau Cruises must be paid for all such oversized or excess luggage prior to your departure on the relevant service.

  5. Oversized and excess luggage may only be pre-booked by informing the ticket office at the time you make your booking for a service.
  6. We accept no responsibility for luggage for which no fee has been charged.
  7. To the extent permitted by law, Kawau Cruises shall not be liable under any circumstances whatsoever for:
    1. any loss of, or damage caused to, your freight, bulky items, luggage or personal belongings while being loaded on or off, and while on board, the vessel; and/or
    2. any freight, bulky items, luggage or personal belongings that are left on the vessel after you depart.
  8. Kawau Cruises’ liability for freight, bulky items, luggage or personal belongings that is under Kawau Cruises’ care and control, and for which a separate fee has been charged, is limited to liability pursuant to the Carriage of Goods Act 1979. The Act limits Kawau Cruises’ liability to $1,500 per person. You should arrange your own insurance to cover amounts over $1,500.
  9. The Driver has the right to inspect the contents of any passenger’s freight or luggage.
  10. No dangerous items (including, but not limited to, fuel, anything with a fuel tank, gas cylinders, noxious plants or animal pests, paint and/or batteries) may be carried in any freight, bulky items or luggage. The transportation of any dangerous item must be declared to the Driver of the vessel prior to departure and the transportation of any such item will be at the Driver’s sole discretion.

#11 Animals:

  1. No animals (including dogs and cats) are permitted on Department of Conservation islands and certain other areas, and accordingly no animals will be allowed on any services to those destinations.
  2. Dogs may travel, free of charge, on all services to Kawau Island subject to:
    1. the owner of the dog following the Driver of the vessel’s instructions (which may include, amongst other things, a requirement that the dog wear a muzzle);
    2. the dog being kept outside of the cabin of the vessel, on a lead and under the control of the owner at all times; and
    3. the owner being responsible for cleaning up any mess that their dog may cause.
#12 Third party operators: Kawau Cruises may sell the services of third parties who are not connected with Kawau Cruises and whose operations are outside the control of Kawau Cruises. We accept no responsibility or liability for the services provided by such third party operators.
#13 Consumer Guarantees Act: If you acquire or hold yourself out as acquiring for the purposes of a business any services to which these terms and conditions apply, the provisions of the Consumer Guarantees Act 1993 shall not apply to our supply of such services.
#14 Governing law: These terms and conditions are governed by the laws of New Zealand.
 

TICKETS PURCHASED THROUGH WEBSITE

 

#1 Booking confirmation and ticket collection: Any booking confirmation received by you after booking tickets through the website of Kawau Cruises (2010) Limited (“Kawau Cruises”, “we”, “our” or “us”) is not a ticket and cannot be used for travel. At least 30 minutes prior to the schedule departure time, you must:

  1. present your booking confirmation at our ticket office, together with your identification;
  2. provide any proof of age that may be requested, before you can collect your tickets.
#2 Collection of tickets: Tickets may only be collected from our ticket office during office hours and not on the vessel.
#3 Non-refundable: Any ticket purchased is non-refundable and non-transferable, and only valid for the date and time (if any) shown on the ticket.

#4 General terms and conditions: Any tickets purchased through this website are subject to:

  1. Kawau Cruises’ general terms and conditions which can be found on this website; and
  2. any particular terms and conditions printed on the ticket,

and if there is any inconsistency between the terms and conditions on this website and the terms and conditions on the ticket, the terms and conditions on the ticket shall prevail.

#2 Intellectual property rights:
